Terms and conditions
This English text is for convenience. The Dutch version is legally authoritative. Algemene voorwaarden
In brief
- A booking is confirmed after you accept a written quote and pay a 30% deposit.
- Free reschedule or cancellation until 7 days before the session; after that, article 6 applies.
- Indicative rates are on services; mixing includes 2 revision rounds as described on service pages.
- Dutch law applies; consumers may also use courts in their country of residence where permitted.
1. Scope
These terms and conditions (« Terms ») apply to services provided by Nitentxara B.V. (« Nitentxara », « we ») from the studio at Overtoom 551, 1054 LL Amsterdam, including vocal and rap recording, live band recording, mixing, mastering and podcast and voice-over, as described on the site and in your quote.
The Terms apply together with any specific conditions in an accepted quote. If they conflict, the quote prevails. Only written deviations bind us. By accepting a quote or paying a deposit, you agree to these Terms and our privacy policy.
2. Definitions
| Term | Meaning |
|---|---|
| Client | The individual or company that accepts a quote. |
| Consumer | A natural person acting outside their trade or profession. |
| Business client | A client who is not a consumer. |
| Quote | Our written offer describing the work, date, price, deposit and any special terms. |
| Session | The reserved studio time or agreed remote work period. |
| Business day | Monday to Friday, excluding public holidays in the Netherlands. |
3. Quotes and booking
Send a request via contact, 020 244 8916 or [email protected]. We usually send a quote within 1 business day. A quote stays valid for thirty days unless another period is stated. A slot is firm once you accept the quote in writing and we receive the deposit under article 5. Until then, we may assign the slot elsewhere.
Distance contracts are confirmed by email with essential details. We may decline a request for safety reasons, unrealistic timing or legal incompatibility.
4. Prices and VAT
Services and service pages show guide prices including 21% VAT, for example Vocal and rap recording from €95 per hour or €680 for a full day. Mixing starts at €185 per track; mastering at €90 per track; podcast at €235 per episode. The binding price is in your quote.
Extra hours or add-ons outside the quote are charged only with your written approval, at the relevant service rate. Business clients may receive net amounts on request (for example €78.51 per hour).
5. Deposit and payment
When booking, you pay 30% of the quoted amount as a deposit, offset against the balance. Payment is by bank transfer; in the studio we accept card payment for the balance.
Consumers pay the balance on the session day or when final files are delivered for remote work. Business clients pay within 30 days of the invoice date unless the quote says otherwise. Late payment may incur statutory commercial interest and reasonable collection costs.
Until full payment we may withhold final mix or master files; session files are kept as in article 10.
6. Reschedule and cancellation by the client
| Timing | Effect |
|---|---|
| More than 7 days before the session | Free reschedule or cancellation; on cancellation the deposit is refunded within 14 days. |
| From 7 days down to 72 hours before start | Deposit may be moved once to a new date within 3 months; otherwise the deposit is forfeited. |
| Less than 72 hours or no-show | Deposit and reserved time remain due, except in cases of force majeure. |
Send requests in writing to [email protected]. Arriving late shortens the session without refund if the next slot is booked. These rules do not limit statutory withdrawal where it applies (article 7).
7. Withdrawal for distance contracts
If you are a consumer and conclude a distance contract (email, phone, form), you generally have 14 days to withdraw without giving reasons, unless a statutory exception applies.
If you ask us to start before that period ends, you confirm that explicitly. If you withdraw afterwards, you pay a proportionate amount for work already performed. For services fully performed at your request within the withdrawal period, withdrawal no longer applies to that part.
Withdraw in writing via [email protected] or post to Overtoom 551, 1054 LL Amsterdam. We refund within 14 days using the same payment method unless agreed otherwise.
8. Cancellation by Nitentxara
If we must cancel due to illness, equipment failure or an incident on the premises, we notify you as soon as possible and offer another date. If none works, we refund amounts paid for undelivered services within 14 days. We do not replace the booked engineer without your agreement.
9. Running sessions
Opening hours: Monday to Friday 10:00–20:00, Saturday 10:00–18:00. Closed Sunday. By appointment only.. The live room suits up to 5 musicians at once; the vocal booth is about 7 m². Participants under 16 need written consent from a parent or guardian who books and pays; under 18, a responsible adult stays on site.
Follow safety instructions, treat gear with care and respect neighbours and other artists. No smoking or vaping indoors. We may stop a session if people or equipment are at risk; the remaining fee stays due. Damage to studio property through intent or gross negligence is charged to the client.
Practical tips are in our guides, for example prepare your voice for the studio or rehearse before recording.
10. Files, delivery and archive
Unless the quote says otherwise, we deliver WAV files via download link or on media you provide. Remote jobs start once complete, usable stems arrive; see deliver stems for a mix.
We keep session and project files for 12 months after the last activity, then delete them unless you agree a longer retention in writing. You remain responsible for your own backups.
11. Revisions
Mixing includes 2 revision rounds as on the service page; mastering includes one round. A round is one bundled list of notes. Extra rounds or a new artistic direction after approval are quoted separately. Loudness guidance: loudness and mastering.
12. Intellectual property
Your works. Music, lyrics and other material you supply stay yours or your rights holders’. You warrant you have the rights needed for samples, covers and assets you bring.
Recordings. When you initiate and pay for a recording, we assume you (or your label) obtain producer rights in the phonogram; we do not claim co-ownership of your takes after full payment.
Studio materials. Our templates, presets and methods remain ours. We do not use your recordings to train AI models or clone voices without separate written consent.
References. We mention your project as a reference only with your written approval.
13. Liability
We perform work with the care expected of a professional studio. Artistic outcome also depends on your preparation and choices and is not guaranteed. Our liability is limited to direct damage from an attributable breach, except where mandatory law says otherwise.
For business clients, total liability per assignment is capped at the invoice amount for that assignment, unless we acted with intent or conscious recklessness. Indirect loss, lost profit or missed releases are excluded. See the disclaimer for site content.
14. Force majeure
In force majeure — power cuts, pandemic, government measures or failure of essential suppliers — performance is suspended for as long as the event lasts. Parties agree a new date; if delay exceeds 28 days, either party may terminate in writing and we refund prepaid amounts for undelivered services.
15. Personal data
We process personal data under our privacy policy. Business clients who supply artist or guest data may need a data processing agreement with us.
16. Complaints
Send complaints in writing to [email protected] or our postal address. We acknowledge receipt and respond within a reasonable time. Consumers may also use the EU online dispute platform: ec.europa.eu/consumers/odr. We do not automatically join a certified dispute board; disputes may go to a competent court.
17. Law and forum
Dutch law governs these Terms. Consumers may bring claims before courts in their place of residence where mandatory rules allow. Business disputes between parties fall under the Amsterdam courts unless mandatory law provides otherwise.
18. Miscellaneous
If a clause is void, the rest remains in force. Failure to enforce a right is not a waiver. We may update these Terms; the version dated 15 October 2026 applies to new bookings. If translations differ, the Dutch text prevails. Questions? Contact us or read the FAQ.
